Upcoming Changes to Spousal Open Work Permits in Canada

In late 2024, Immigration Minister Marc Miller announced upcoming restrictions to spousal open work permits (SOWPs).

These changes are expected to roll back the January 2023 expansion, which allowed spouses of workers in all Tier categories (0–5) to apply. While it is speculated that eligibility may be limited to workers in Tiers 0 and 1, this has not been confirmed—Tiers 2 and 3 may still qualify, or restrictions could be even tighter.

Additionally, workers will need at least 16 months remaining on their permits to apply for their spouse’s work permit. This change will exclude workers with shorter permits, such as those completing one-year programs.
